The new EARN IT Act poses an even greater threat to encryption, experts say

The Senate Judiciary Committee will consider legislation Thursday that privacy advocates are warning could pose a major threat to encrypted technologies. “Everyone who communicates with others on the internet should be able to do so privately,” a diverse group of civil society groups wrote in a letter Wednesday to the committee’s leaders. “But by opening the door to sweeping liability under state laws, the EARN IT Act would strongly disincentivize providers from providing strong encryption.” The Eliminating Abusive and Rampant Neglect of Interactive Technologies Act (EARN IT Act), introduced for the first time in 2020 by Sens. Lindsey Graham, R-S.C., and Richard Blumenthal, D-Conn., would remove legal liability immunity from tech platforms found in violation of federal or state laws regarding child sexual abuse materials (CSAM). Senate fails to amend cryptocurrency reporting requirements, moving fight to the House

The Senate stopped short Monday of passing an amendment that would have altered language in the current $1 trillion infrastructure bill to narrow the definition of parties that will be required to report cryptocurrency sales to the Internal Revenue Service. Senators failed to reach unanimous consent because of an objection to an unrelated requested attachment to increase military spending. A group of Senate Republicans and Democrats as well as representatives of the Treasury Department had struck a compromise to narrow the language on Monday and had hoped to pass the amendment through unanimous consent. Senate fails to confirm new CISA director before two-week break, drawing criticism

The Senate’s failure to confirm a new director for DHS’s top cybersecurity agency before the chamber goes on a two-week recess has raised ire from cybersecurity leaders who say the role is too important to leave unfilled. President Joe Biden nominated Jen Easterly, a former U.S. National Security Agency official, for CISA director and Chris Inglis as national cyber director in April.
