A former CIA employee accused of being responsible for the largest leak in agency history thinks his case should be thrown out of court. Defense attorneys for Joshua Schulte, who’s on trial now in the U.S. Southern District of New York for allegedly providing WikiLeaks with a cache of the agency’s hacking tools, filed a motion on Tuesday for a mistrial. The argument undergirding the request remains classified, though the defense says the request is “based on Brady and other violations.” The mention of “Brady” is an apparent reference to the Brady Rule, which requires prosecutors to provide any favorable evidence to a defendant that could negate the guilt of the accused. The request comes after prosecutors and the defense have sparred over the questioning of a witness who testified against Schulte. A former CIA employee was charged on Monday with leaking a collection of U.S. hacking tools used for global spying. Joshua Adam Schulte, who previously worked for both the NSA and CIA, faces charges for allegedly stealing and transmitting classified national defense information. He’s suspected of transmitting the data to WikiLeaks who then published the information under the name “Vault 7.” Schulte, 29, is also charged with possession and transportation of child pornography. The maximum penalty is 130 years in prison. The Vault 7 leaks became public in March 2017, giving an unprecedented look at the CIA’s hacking capabilities. WikiLeaks spent subsequent months publishing further data from the leak. Prosecutors say Schulte stole the data beginning in March 2016. Assistant Director-in-Charge William F. Sweeney, Jr. said Schulte “utterly betrayed this nation.” Schulte pleaded not guilty to the child pornography charges and has steadfastly denied any involvement in the Vault 7 case. U.S. government officials are looking into a former CIA employee for his possible role in leaking a trove of the agency’s cyber espionage tools to WikiLeaks. Joshua Adam Schulte, who has worked for technical directorates at National Security Agency and the CIA, was charged with child pornography possession in August 2017. However, prosecutors have publicly revealed Schulte to be a key suspect in the Vault 7 leaks after seizing computer equipment, notebooks and handwritten notes from his apartment. The Washington Post first reported on Schulte’s relation to the case. Schulte, 29, has pleaded not guilty to the child pornography charges. His lawyers maintain he had nothing to do with the Vault 7 leaks, and he has not been charged with any crimes related to the case.
